Yes in ky once the bird leaves the roost you can shoot him and they define the roost as where the bird spends the night. I have been set up under birds before that flew to another tree right after day light that I could have shot legally but I wouldn't because i didn't think it would be fair. But the bird I killed had been on the ground for several hrs because I had hunted them all morning and it was about 11:40 when I finally caught back up with them, the only reason he went back into a tree was because I had shot at his buddy and I guess they didn't know where the shot came from.
Thanks everyone for the kind words and as far as the gun I love hunting with that gun, between my dad, my step son and my myself that's the gun we have killed all of our birds with for the last 2 springs.
