Situation:
I have a fairly large tract of land across the road from me. It is posted and NO hunting is allowed. As a matter of fact, the owner had some issues a while back with some slobs, and now.....no hunting.....no scouting......no hiking.......no trespassing.....no nothing.......nobody, no exceptions. Virtually untouched mountain land, except for the 4 wheelers that still seem to sneak in.
I like to practice my calling from my location to hear the responses I get from various calls and methods. Since no one is hunting these birds and can't hunt them, I don't think I'm "educating" anybody's birds that may be hunted. Even the surrounding land is mostly houses on a few acre lots, so there is virtually no opportunity within at least 2-3 miles.
Do you think it is unethical to continue doing this, as I really like to call and practice on real birds.
Your comments are appreciated and will be taken into consideration.
Please be kind....that's why I'm asking.
Thanks.
Call away! What's the difference really in the end.
Neal
I see no issue at all.
Thanks for the replies. I didn't think I was doing anything wrong, but I know pre-season calling and educating birds is a big no, no.
I practice calling on live birds in the state parks near me. No hunting is allowed there either and nobody cares anyway. So, go for it.
Jim
If ya can't hunt them and no one else can, ya might as well have fun!

Absolutely.
I'd do the same thing if I was positive nobody could hunt around there.
Call away! That's a good way to learn
I think you should get to know the person really well and eventually get permission to hunt it once they figure out what kind of a person you are. I wouldn't just run in and ask immediately, good luck!
BTW, living that close, you could help keep people \ trespassers off.
You're a bird watcher....and nobody has any problems with someone doing some interactive birdwatching.
I've done it, and called in some nice birds wearing jeans and a t shirt...hehe
I see no problem calling "just to see if you get an answer."
I agree with all the above. My family and I sometimes go for hikes at our state parks in the spring and sometimes I call to see if I can't get some gobbling going on and nobody has cared ever.
My first question would be is whether or not you can hunt on your side of the fence? If you can hunt on your side, I would not be calling to those birds until the season is in,...and then I would pull them across the property line. If you can't hunt your side, then call all you want to.
 You are all set here.

Yep, this is what I'd do.......that old boy don't own em birds!
Exactly,...lot's of folks don't understand wildlife laws in the U.S. Non-migratory wildlife in each state, with few exceptions, is owned by the citizens of the state. Just because a guy has turkeys on his place does not mean he owns them. He does have the right to control access to his property, however.
So, if you can call those birds off of his place onto a spot you can legally shoot them, as soon as they take one step over the property boundary, they are fair game. There is nothing I like better than getting a gobbler to come across a fence line where the property owner does not allow hunting, and especially if they are anti-hunters.
That is not because I want to be smug or nasty,...it is just the principle of the thing.
Be sure it is legal - in Illinois it is not legal to use a turkey call prior to the season starting to locate birds. Granted you are not locating, but it may not be legal until the season actually starts. Other than that, have fun with it!
This is illegal in some states. Check your regulations. I would not do it anyway even if it were legal, but at the least you should make sure its legal.

I know the person, but NOBODY can go on his land. He has had too many bad experiences....garbage, 4 - wheelers where they shouldn't be, people not asking for permission, etc. he just got sick of it. Can't say that I blame him. We talk occasionally on a "friendly" basis, but I know his answer.

Can't hunt on "my side".....too residential. Although that is where the birds, deer and other game like to call home. LOL

Not that I violate laws, but, I would have a real problem with ANY law that tells me I can't sit on MY DECK on MY PROPERTY and practice my turkey calls. Noise ordinances are the only thing I could think of, and there aren't any. They sure sound different outside vs inside. I think I would have a "Field Day" with this one, if I were cited for this one, for this reason, (using a call before season). However, this is what our world is coming to, but that another story I won't get into. As a matter of fact I don't know or care if it's illegal to practice your calling before season, as I'm doing it.....see ya in court if it is!
P.S. I'm curious....why would you still not do this?
Thanks.
No issue IMO.
I don't make your laws and don't know if it is illegal in your state or not. I was merely trying to make you aware of the possibility. By the way, I don't care if you follow your laws or not. QUIT YELLING! You will not see me in court!

Sorry!
I didn't mean no disrespect to you and certainly wasn't implying I would see you in court. I was implying I would see the citing LEO in court. Sorry if I sounded rough, but these things (silly laws), really irk me. I apologize if you thought my words were directed at you. I mean no harm and wish you a 20+ pounder!
Must be the long cold winter getting to me.....peace.
